TERMS AND CONDITIONS
1. Entry Conditions
a) To enter into this prize competition (the “Competition”) entrants must create an application or an experience that innovates the fashion and retail industry by enhancing the consumer experience (the “App”). Entry into this Competition constitutes acceptance of these terms and conditions.
b) Only one App entry per person or team (teams can have a maximum of 4 members). No purchase necessary.
c) All entrants must be aged eighteen or over and have a UK postal address. Employees of Westfield Europe Limited (“Westfield”), Tecnamedia LLC (t/a Decoded Fashion) (“Decoded Fashion”) and any company directly involved in the Competition, their families, dependents and agents and any other person connected with the Competition may not enter.
e) Westfield and Decoded Fashion reserve the right to refuse to accept any App entry and/or to select a winning App entry at their absolute discretion (subject to review and approval by the judging panel). Judging criteria to decide the winner shall be the entry which in the opinion of the judges is the most original, innovating and user enhancing.
f) Westfield is the promoter of this Competition.
g) Failure to comply with these terms and conditions will automatically render an App entry void. These terms and conditions shall be governed and construed in accordance with English law.
2. Competition Conditions
a) Entrants must select one of the three fashion challenges and complete it during the Competition. The challenge must be completed by 14:00 BST on 21 September 2014. Entrants must give a two minute presentation about their App to the judging panel and answer a 60 second Q&A session.
b) The App must create tangible impact (including but not limited to engagement, conversion and revenue) and be suitable to be developed into a working project within 6 months from the Competition.
c) The App may be built in any code language provided all back-end code is new and coded during the Competition. Entrants may use APIs, open source libraries, previously built hardware, sprites, wireframes and any other design elements.
a) The winning App will be selected by a judging panel after the Competition has closed and will win a trip to San Francisco to pitch their concept to Westfield Labs LLC (the “Prize”). The Prize will include: (i) economy flights (subject to availability) on the dates agreed between Westfield and the winner (or winners if the winning App is from a team entry) (ii) three nights accommodation; and (iii) £100 per day, per person, to be spent on food and travel expenses. No expenses incurred in connection with the Competition will be paid other than as set out in these terms and conditions. Winners are responsible for organising their own travel insurance policy at their own cost. Such policy to be with a reputable insurer and provide adequate cover for travel interruption, loss and damage to property, medical expenses, death and personal injury for the duration of the trip.
b) The judging panel’s decision is final and no correspondence will be entered into.
c) There are no cash alternatives: the prize must be accepted as offered, is non transferable and subject to availability. Westfield reserves the right to cancel any prize if it has reasonable grounds for believing that a prize winner has, or has attempted to sell, transfer or exchange their Prize. Westfield reserves the right to substitute a prize or part thereof with a prize of equal or higher value in the event of unforeseen circumstances and/or withdraw or amend the promotion at any time without prior notice.
d) Use of a false name or address, for example using a name by which the entrant is not usually known will disqualify them from receiving any prize.
e) The winners will be bound by any applicable airline and accommodation terms and conditions.
a) The winner(s) will be formally notified by Westfield on or around 21 September 2014. If a winner does not respond within any period specified in the notification or is not available, Westfield reserves the right to select an alternative entrant to receive the Prize.
b) The name and county/town of the winner will be available for one month after the Competition closing date by sending a stamped addressed envelope to the promoter Westfield Europe Limited, Legal Department, 6th Floor, MidCity Place, 71 High Holborn, London WC1V 6EA.
The winner agrees to participate in any and all advertising, promotion or other commercial activities relating to the Competition and consents and agrees that their photograph, image, likeness and voice may be used by Westfield and/or Decoded Fashion in all related promotional activity without any rights of prior approval or inspection. Competition winners agree to keep confidential any knowledge about Westfield or Decoded Fashion, their businesses and personnel received by them as a result of the Competition.

7. Intellectual Property Rights and Use of Entries
a) Westfield nor Decoded Fashion, unless agreed with the entrants, claim any rights of ownership in the App entries. As such, ownership and copyright in the Apps will be retained by the entrants. However, in consideration of Westfield and Decoded Fashion agreeing to consider entrants to the Competition, each entrant hereby agrees that Westfield and Decoded Fashion (and third parties authorised by Westfield) may make any and all entries available in their publications and on their websites and any other media, whether now known or invented in the future. The entrants agree to grant Westfield (and third parties authorised by Westfield) a non-exclusive, worldwide, perpetual, royalty free licence to use, display, publish, transmit, copy, make derivative works from, edit, alter, store the entries for such purposes. The entrants of the winning App grant Westfield the first right of refusal to develop alongside them.
b) Westfield nor Decoded Fashion guarantee to use or otherwise make available any App entry. Westfield and Decoded Fashion may, in their absolute discretion, credit the entrants of the winning App on any medium they it consider fit.
c) Westfield and Decoded Fashion may, in appropriate circumstances, and in their sole discretion, reject, edit, remove or disable access to any entries that appear to be legally or otherwise problematic e.g. infringe the copyright or other intellectual property or privacy rights of others, are defamatory or for any other reason.
d) Entrants warrant that his/her App and all information submitted to Westfield will not infringe the intellectual property, privacy or other rights of any third party, and will not contain anything which is libellous, defamatory, obscene or indecent. If necessary, Westfield reserves the right to screen, filter and/or monitor and remove information provided by the entrants.
